意味

1998年の「国内強制移動に関する指導原則」（国連文書 E/CN.4/1998/53/Add.2、1998年2月11日、附属書）の「INTRODUCTION: SCOPE AND PURPOSE」第2項が定義する。英正文は「For the purposes of these Principles, internally displaced persons are persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of or in order to avoid the effects of armed conflict, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized State border.」。決め手になるのは最後の一句、国際的に承認された国境を越えていないこと。

使い方と注意

誰が決めるか：指導原則は条約ではなく、国連人権委員会に提出された事務総長特別代表の報告書の附属書として公表された文書である。定義は「For the purposes of these Principles」と限定した記述的なもので、認定機関も認定手続も置いていない。したがって「国内避難民と認定される」という言い方はしない。国が国内法で登録制度を設けている場合は、その登録の話として別に書く。原則1第1項は「Internally displaced persons shall enjoy, in full equality, the same rights and freedoms under international and domestic law as do other persons in their country.」と定め、国内避難民が自国民として持つ権利は変わらないことを確認している。／混ざりやすい語と、同じ意味で使ってはいけないこと：「難民」（国境を越えていることが要件。国内避難民は定義上これを満たさない）、「避難民」（日本の入管庁の区分。日本に入国した人を指す）、「避難者・避難してきた人」（日常語）。／数字を書くときは出所と基準日を必ず添える。理事会実施決定（EU）2026/1912の前文(9)は、国際移住機関（IOM）の推計として「as of December 2025, 3 712 000 people are internally displaced within Ukraine, of which 71 % had been displaced for over two years and 82 % had been displaced for over a year」と記している。これはEUの決定がIOMの推計を引用しているという事実の出典であって、IOMの原資料に当たったものではない。
